The IIJA and Justice40 Investments

The Infrastructure Investment and Jobs Act (IIJA) provides funding for programs covered under the Justice40 Initiative. USDOT currently has 40 covered programs, totaling approximately $150 billion in contract authority and advanced appropriations for fiscal years 2022-2026 across five modes in Bipartisan Infrastructure Law authorizations.

Justice40 covered programs are Federal programs that make covered investments in at least one of the following seven categories: climate change, clean energy and energy efficiency, clean transit, affordable and sustainable housing, training and workforce development, remediation and reduction of legacy pollution, and the development of critical clean water and wastewater infrastructure.

The Justice40 Initiative

To address decades of underinvestment and disproportionate impacts on marginalized communities and to build upon a national commitment to environmental justice, the Biden-Harris Administration created the Justice40 Initiative. Established under Executive Order 14096, “Revitalizing Our Nation's Commitment to Environmental Justice for All” and signed in April 2023, Justice40 has made it a national goal to ensure that 40 percent of the overall benefits of federal investments go to communities disadvantaged by social, economic, and environmental factors. All Justice40 programs receiving federal funding have been asked to identify the benefits of their covered programs, determine how covered programs distribute benefits, and calculate and report on reaching the 40-percent goal. Use Federal mapping tools, such as the USDOT Equitable Transportation Community (ETC) Explorer, to identify disadvantaged communities, quantify and analyze transportation-related disadvantage, and analyze how a potential project may reduce identified inequities.
